Terms of service · Second Foreman LLC

The terms, in plain words

These are the terms for the AI receptionist and the Google Business Profile service sold on this site. Paying for a plan or sending the intake form means you agree to them. The client agreement you get by email repeats them with your details filled in.

1. Who we are

Second Foreman LLC, an Oklahoma limited liability company. Built and operated by an AI agent (Claude), guaranteed by Second Foreman LLC. The company, not the AI, is the party to this agreement and the one responsible to you.

2. What you are buying

Minutes are the talk time on your line in a calendar month. Unused minutes do not roll over. Overage is billed on the next invoice.

3. Going live, and our one promise

After you pay and send the intake, we build your receptionist, test-call it, and email you a call-forwarding card. You are live when your first forwarded call lands. If we cannot get you live within 7 days of a complete intake, your first month is refunded in full. That is the only outcome we promise. We do not promise call volumes, booked jobs, revenue, rankings, or that your listing will appear anywhere on Google.

4. Billing

Monthly in advance, by card through Stripe, starting the day you pay. Prices change only with 30 days’ written notice; you can cancel before a change takes effect. Failed payments pause the receptionist after 7 days and two emails. Refunds other than the go-live promise are at our discretion and in writing; refunds above $100 are decided by the owner personally.

5. Cancelling

Email the word cancel. Service ends at the end of the paid month. We send you the steps to restore your old call forwarding, and we remove ourselves from your Google Business Profile within 7 business days, as Google requires. Nothing is held hostage: your profile, your number and your data were always yours.

6. The AI disclosure, recording notice and emergency line are fixed

Every call opens with “Hi, you've reached [Business Name]. I'm an AI assistant, and this call may be recorded. How can I help?” and the receptionist says “If this is a life-threatening emergency, hang up and dial 911.” whenever it hears danger. These lines are not configurable, by you or by us, and asking us to remove them ends the agreement.

7. What the receptionist is not

It is a receptionist. It is not an emergency service, a dispatcher of record, a medical or safety service, or a replacement for your own judgement on an emergency job. Like every voice platform we run on, we disclaim use in life-safety settings. You agree to set your emergency rules honestly and to keep a working way for true emergencies to reach a person.

8. Texts and calls to your customers

We make no outbound calls and send no marketing texts. The only text a caller receives is one informational confirmation of what they booked, to the number they called from, and STOP ends it. You are the sender of record for those texts under your agreement with us, and you agree not to ask us to send anything else.

9. Google Business Profile

Management starts only after your written consent on the intake form. You stay the Owner; we are a Manager. Replies to reviews are posted only after your explicit approval, standing or per reply. Google Business Profile is free; our fee is for the work, and that line is on every invoice. You are told of changes affecting how customers reach you 48 hours ahead. We never auto-reject Google’s suggested edits, never guarantee rankings, and never represent ourselves as Google. The full notice is at /third-party and is part of these terms. If Google suspends your profile for any reason, we help with the one appeal Google allows and pause our fee while it is suspended; we cannot promise the outcome.

10. Reviews and endorsements

We will not write, buy, seed, gate or suppress a review or testimonial for you, and you agree not to ask. Review-request emails we send on your behalf go only to customers you actually served and ask for honest reviews, good or bad.

11. Your responsibilities

12. Our responsibilities and limits

We run the service with reasonable care, keep a tested backup voice provider, export your configuration nightly, and tell you within one business day of any outage affecting your line. Our total liability to you for anything arising from this agreement is capped at the fees you paid us in the 3 months before the claim. We are not liable for lost jobs, lost revenue or indirect losses, and we are not liable for what a third-party platform (Google, your calendar provider, your carrier) does with your account. Nothing here limits liability that the law does not allow us to limit.

13. Data

Handled as the privacy policy says; it is part of these terms. Your business data is yours; we get a licence to use it only to run the service for you.

14. Disputes

Oklahoma law governs. Write to us first; the owner reads every dispute personally and answers within 10 business days. If that fails, the courts of Oklahoma County, Oklahoma, have jurisdiction. No gag clauses: nothing in these terms stops you from writing an honest review of us anywhere, and we will never condition a refund on deleting one.

15. Changes to these terms

Changes are emailed to clients 14 days before they take effect. Continuing past that date is acceptance; cancelling before it is free.
